His answer is no. Instead, Baude points to the birthright citizenship executive order as a more egregious violation. This order directly contradicts the Fourteenth Amendment’s clear guarantee that “All persons born or naturalized in the United States… are citizens.” It attempts to rewrite constitutional law on a matter where the President holds no authority, striking at the very core of American citizenship.
Another stark example Baude highlights is the administration’s unilateral suspension of the TikTok ban—a law passed by bipartisan majorities and upheld by the Supreme Court.
