In a decisive rebuke to President Trump’s border crackdown, a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit ruled Friday that the president’s executive order suspending asylum access at the southern border is unlawful. The court affirmed that under the Immigration and Nationality Act (INA), migrants have a clear right to apply for asylum, and the president cannot unilaterally override that right through executive fiat.

The ruling stems from Trump’s Inauguration Day 2025 proclamation declaring the southern border an “invasion” and suspending the “physical entry” of migrants and their asylum claims until further notice. The court found no statutory authority in the INA for the president to bypass Congress or create his own procedures to block asylum seekers. Judge J. Michelle Childs, appointed by President Biden, wrote that Congress never intended to grant the executive branch such sweeping removal powers that would undermine mandatory protections for asylum applicants.

Despite White House claims that the asylum ban falls within Trump’s powers as commander in chief, the court’s opinion makes clear the administration’s actions exceed legal limits. The Department of Justice plans to seek further review, but the order is currently blocked from taking effect.

Immigrant rights advocates hailed the decision as a critical victory for the rule of law and human rights. Lee Gelernt of the ACLU called the ruling “essential for those fleeing danger who have been denied even a hearing to present asylum claims under the Trump administration’s unlawful and inhumane executive order.” The Las Americas Immigrant Advocacy Center, a plaintiff in the case, emphasized that presidential whims cannot override established legal protections.

This ruling adds to a growing list of legal defeats for Trump’s authoritarian border policies, which have systematically dismantled asylum access and placed vulnerable migrants in peril. While Biden’s administration also restricted asylum pathways, Trump’s explicit suspension of asylum claims was an unprecedented assault on democratic norms and immigration law.

For migrants stranded in Mexico and elsewhere, the decision offers a glimmer of hope that their right to seek protection in the U.S. will be restored. But as advocates caution, the fight is far from over, and the administration’s efforts to weaponize executive power against asylum seekers remain a clear threat to justice and human rights.
