The Council on American-Islamic Relations (CAIR) and its political arm, CAIR Action, have formally submitted a comprehensive report to Congress making the case for impeaching Secretary of Defense Pete Hegseth. The report, titled “The Case for Impeaching Secretary of Defense Pete Hegseth,” details numerous violations of U.S. law, constitutional limits, and international humanitarian norms tied to the Trump administration’s war on Iran.

This unprecedented move comes as Hegseth testifies before the Senate Armed Services Committee amid heightened tensions following U.S. and Israeli attacks on Iran. Just yesterday, he defended a $1.5 trillion Pentagon budget and the administration’s execution of what CAIR calls an illegal war.

According to the report, Hegseth systematically dismantled legal oversight within the Pentagon designed to prevent civilian harm. This included removing offices tasked with ensuring compliance with the laws of war and discarding traditional rules of engagement. The consequences were catastrophic: at least 1,700 Iranian civilians killed, including more than 250 children, and widespread destruction of civilian infrastructure such as schools, hospitals, water systems, and religious sites.

The report accuses Hegseth of not only enabling but actively setting conditions for these attacks, citing public statements by senior officials that reveal intent to target civilians. It also highlights the disturbing use of religious rhetoric in military justifications, further fueling unlawful violence.

Crucially, the report asserts that the war was launched without congressional authorization or evidence of an imminent threat, violating the War Powers Resolution and Article I of the Constitution. It calls these actions war crimes under the War Crimes Act (18 U.S.C. § 2441).

Robert S. McCaw, CAIR’s Government Affairs Director and co-author of the report, emphasized that Congress now has a clear evidentiary basis to act: “This report establishes a factual record demonstrating that the use of force was undertaken without lawful authorization and in a manner that resulted in foreseeable and preventable harm to civilians.”

Basim Elkarra, Executive Director of CAIR Action and co-author, added, “Secretary Hegseth did not merely fail to prevent attacks on civilians in this illegal war; he set the conditions that made them inevitable.”

With the unauthorized war nearing the 60-day mark under the War Powers Resolution, the administration faces a legal deadline to seek congressional approval for continued hostilities. CAIR and CAIR Action’s report aims to reinforce the constitutional limits on the use of military force and push for accountability at the highest levels.

This report is a stark reminder that unchecked executive power in matters of war can lead to devastating consequences for innocent civilians and profound breaches of U.S. law. Congress must now decide whether to uphold its constitutional duty or continue enabling a pattern of illegal military aggression.
