Companies are entitled to tariff refunds after SCOTUS decision, judge rules

WASHINGTON (TNND) — A federal judge in New York ruled on Wednesday companies that paid tariffs put in place by the Trump administration are entitled to refunds.

Judge Richard Eaton of the U.S. Court of International Trade wrote that “all importers of record’’ were “entitled to benefit’’ from the Supreme Court ruling.

The Supreme Court struck down President Donald Trump's tariffs under the International Emergency Economic Powers Act, or IEPPA.

Eaton's ruling offered clarity about the process for tariff refunds. He wrote he “will hear cases about the refund of IEEPA duties.’’

Atmus Filtration, a Nashville company that makes filters and other filtration products, brought the case forward. The company claimed the right to a tariff refund following the Supreme Court ruling.

The federal government collected over $130 billion in tariff revenue through mid-December. However, according to the Penn Wharton Budget Model, the Trump administration's refunds could total up to $175 billion.

U.S. Customs and Border Protection must come up with a way to process the refunds. Although customs refunds tariffs if there is an error, the system is not designed for a mass refund," said trade lawyer Alexis Early, a partner at Bryan Cave Leighton Paisner.
