The Court of International Trade delivered a rare rebuke to President Donald Trump on Thursday, declaring his sweeping 10 percent global tariff on most U.S. imports unlawful. Yet the court simultaneously allowed the tariffs to remain in effect during the appeals process, keeping American consumers and businesses hostage to Trump’s trade war folly.

Trump imposed these tariffs earlier this year, citing authority under section 122 of the Trade Act of 1974. This move came after the Supreme Court struck down his previous worldwide tariffs under the International Economic Emergency Powers Act (IEEPA), a legal blow that should have curtailed his tariff tantrums. Instead, Trump simply switched to a different statute, hoping to bypass legal limits on his trade powers.

As Nicholas Creel noted in World Politics Review back in February, none of the laws Trump has at his disposal can match the speed and flexibility of the now-invalidated IEEPA. This legal juggling act exposes the administration’s desperation and disregard for the rule of law in pursuing its protectionist agenda.

The consequences are far from abstract. The tariffs have fueled economic chaos, disrupted global supply chains, and triggered retaliatory tariffs from U.S. allies and adversaries alike. Corporate cronyism has thrived as favored industries benefit from protectionist barriers at the expense of ordinary Americans facing higher prices.

Worse still, the Supreme Court’s rejection of Trump’s earlier tariffs created a dangerous asymmetry in U.S.-China trade relations. China retains the ability to impose or lift tariffs and restrict critical rare earth materials at will, while Trump’s powers have been legally neutered. This imbalance has handed China’s Xi Jinping a strategic advantage ahead of a crucial U.S.-China summit.

This ruling should be a wake-up call: Trump’s tariff policies are not just misguided but illegal, undermining American economic stability and democratic accountability. Yet with the tariffs still in place, the damage continues while the courts untangle the mess Trump made.
