The Court of International Trade has delivered another decisive rebuke to Donald Trump’s trade policies, ruling 2-to-1 that his sweeping 10% tariffs on most imports were imposed illegally. This ruling follows the Supreme Court’s earlier rejection of Trump’s use of emergency powers to enact tariffs, underscoring a pattern of executive overreach and disregard for the law.
The tariffs, which Trump imposed unilaterally after returning to the White House, were supposed to spark a manufacturing boom and correct trade imbalances. Instead, they have inflicted economic harm on American consumers and businesses, driving up prices on everyday goods without delivering the promised jobs or trade improvements.
Rep. John Larson (D-Conn.), a member of the House Trade Subcommittee, condemned the tariffs as an illegal tax on American families and small businesses. “The average household has already had nearly $2,000 stolen from them by this administration,” Larson said, highlighting the real-world impact of the tariffs as grocery bills and gas prices soar.
Economic data from the first quarter of 2026 confirms the failure of Trump’s trade strategy. According to the American Economic Liberties Project’s Rethink Trade program, US manufacturing employment has dropped by 82,000 jobs since Trump’s return, and the trade deficit actually widened compared to the previous year.
Lori Wallach, director of Rethink Trade, criticized the administration’s chaotic tariff use and misplaced trade demands. Instead of addressing the mercantilist abuses that contribute to the trade deficit, Trump’s policies have squandered leverage and undermined efforts to support American manufacturing.
This latest court ruling only blocks tariff collection from some plaintiffs, including businesses and Washington state, but the Trump administration is expected to appeal.
