DOJ Report Claims Biden Administration Targeted Christians with Disparate Penalties and Investigations

A DOJ report compiled by the Trump-era task force alleges that the Biden administration imposed harsher penalties on Christian groups and pro-life activists compared to secular or liberal counterparts. The report highlights selective enforcement of laws like the FACE Act and Johnson Amendment, alongside disproportionate fines against Christian schools and minimal faith-based outreach to Christian organizations by federal agencies.

The Department of Justice, under acting Attorney General Todd Blanche, released a report accusing the Biden administration of systemic anti-Christian bias within federal government enforcement and outreach. The 200-page report, assembled by the Trump administration’s Task Force to Eradicate Anti-Christian Bias, claims that Christian individuals and institutions faced harsher treatment than their secular or liberal peers, with “devastation” inflicted on many Christian Americans.

One of the report’s central findings is the disparate application of the Freedom of Access to Clinic Entrances (FACE) Act. This federal law, designed to protect abortion providers and religious institutions, was reportedly enforced more severely against pro-life activists. According to the report, the Biden DOJ sought average sentences of 26.8 months for pro-life defendants, compared to 12.3 months for pro-choice defendants. Ultimately, pro-life defendants received average sentences of 14 months, while pro-choice defendants were sentenced to an average of just 3 months.

The report also accuses the Biden administration of selectively enforcing the Johnson Amendment, which bans nonprofit organizations, including churches, from political campaigning. It cites investigations into Christian congregations like New Way Church in Florida and Grace Church in St. Louis for political activities, while noting no public investigations into over 1,600 faith leaders who supported Joe Biden in the 2020 election.

Further disparities emerged in education enforcement actions. The report notes that 70% of Department of Education enforcement actions targeted faith-based or career schools, despite these schools educating only about 10% of students. Christian schools faced average fines of $815,000, significantly higher than the $228,571 average fines imposed on secular public and private schools. Notably, Grand Canyon University was hit with a $37.7 million fine for alleged deceptive advertising, despite an appeals court finding no wrongdoing. Liberty University faced a $14 million fine for transparency issues, dwarfing fines against major public universities like Pennsylvania State and Michigan State for far more serious offenses.

The Department of Homeland Security’s faith-based outreach also showed a stark imbalance, with 20 Muslim organizations and 18 Jewish groups engaged, but only two explicitly Christian groups included. The report highlights testimony from DHS employees alleging that Christian celebrations like Christmas were discouraged in the workplace, while other religious holidays were not.

Additional concerns raised include the denial of Small Business Administration disaster loans to nearly 170 Christian organizations based on faith, and FEMA allocating less than half of its religious nonprofit funding to Christian groups.

This report, originally published by The Christian Post, reflects ongoing tensions over religious freedom and federal enforcement priorities under the Biden administration. It fits into a broader pattern of conservative critiques accusing the current administration of bias against Christian conservatives, particularly those involved in pro-life activism and politically active churches.

While the DOJ under Biden has emphasized protecting civil rights and religious liberty broadly, this report paints a picture of selective enforcement and uneven treatment that warrants scrutiny. For Americans concerned about government accountability and religious freedom, these findings raise urgent questions about fairness and equal protection under the law.
