The Department of Justice, once viewed as a pillar of impartial law enforcement, is now the biggest loser in its own politically charged indictment of former FBI Director James Comey. The charges, stemming from a deleted Instagram post featuring seashells arranged as “86 47,” are widely dismissed by legal experts as a weak and likely unwinnable case.

Comey’s post, interpreted by some as a veiled threat against President Trump, was “ambiguous” and lacked any clear intent to incite violence, according to John Keller, a former DOJ official who prosecuted violent threats. The Associated Press notes that broad First Amendment protections for political speech make proving the case an uphill battle for prosecutors.

Ken White of The Popehat Report calls the indictment a “grave embarrassment” that showcases the “complete collapse” of the DOJ’s integrity. The traditional “presumption of regularity” that government attorneys act professionally is crumbling, and restoring trust will be a daunting task.

Even Trump-friendly voices struggle to defend the charges. Andrew McCarthy at National Review labels the indictment “bogus” and warns it damages the DOJ’s credibility with courts, potentially inviting retaliatory investigations when Democrats regain power. Fox News legal analyst Jonathan Turley agrees that while the post was “crass,” the First Amendment protects such speech, making the prosecution unlikely to hold up in court.

The indictment reflects a DOJ leadership “got the message” from Trump’s recent moves, including the firing of Attorney General Pam Bondi, according to Glenn Thrush at The New York Times. The department is now focused on appeasing Trump’s “restless efforts to exact vengeance on his enemies,” a strategy that may keep the president temporarily satisfied but risks long-term damage as Democrats prepare to take control of Congress.

Steve Benen at MSNBC warns the prosecution is less about securing a conviction and more about sending a message: federal prosecutors must “play along with the revenge campaign or face unemployment.” This politicization of justice undercuts the rule of law and signals a dangerous shift toward weaponizing federal power for personal vendettas.

Republicans face a tricky political calculus as well. The Washington Post notes GOP candidates would prefer not to campaign on a platform of supporting Trump’s “retribution tour,” especially amid rising gas prices and voter fatigue.

The Comey indictment is not just a bad legal bet; it is a stark symbol of how the Trump administration’s vendetta politics are corroding the foundations of American justice. The Department of Justice’s fall from impartial arbiter to political tool is a crisis that demands urgent attention from all who value democracy and the rule of law.
