In a stunning escalation of politically motivated prosecutions, former FBI Director James Comey was indicted Tuesday over a social media post officials claim threatened then-President Donald Trump. The Justice Department alleges that a photo Comey posted nearly a year ago—showing seashells arranged as the numbers “86 47”—constituted a threat to “take the life of, and to inflict bodily harm upon” Trump, the nation’s 47th president.
The two-count indictment accuses Comey of knowingly making and transmitting a threat in interstate commerce. Yet the government has not presented clear evidence that Comey intended harm. Comey himself denied any violent intent, explaining he believed the numbers referenced a political message and promptly deleted the post after realizing some associated “86” with violence. The phrase “86” is slang for “to get rid of” or “to kill,” but its use in this context remains ambiguous.
Acting Attorney General Todd Blanche, who announced the indictment, refused to detail the evidence proving Comey’s intent, stating only that intent is proven through witnesses, documents, and the defendant’s own statements. Blanche insisted the case is routine and would be pursued against anyone else, despite the clear political overtones and Comey’s fraught history with Trump.
This indictment follows a previous politically charged case against Comey, dismissed after a judge ruled the prosecutor was illegally appointed. Comey’s relationship with Trump was hostile from the start; Trump fired him in 2017 amid the FBI’s investigation into Russian interference in the 2016 election—a probe Comey oversaw in its early stages.
The timing and nature of this new prosecution suggest a pattern of weaponizing the Justice Department to target political opponents and punish those who challenged Trump’s authority.
