Despite the scale of this operation, DHS has failed to conduct the legally required environmental impact assessments or meaningfully consult with local and state officials. This brazen disregard for process and public safety is the latest example of power wielded without accountability — and the tyranny it breeds.

On April 24, 2026, DHS lawyers responded to a preliminary injunction lawsuit filed by the State of New Jersey and Roxbury Township aiming to halt the conversion. DHS claims its actions have caused no harm. But the State and Roxbury’s case is simple: the federal government made a final decision without the necessary environmental or community impact studies, violating the National Environmental Policy Act (NEPA). The warehouse currently has just four toilets and minimal water and sewage infrastructure.
