Former FBI Director James Comey Indicted for Alleged Threats Against President Trump
A federal grand jury in North Carolina has charged ex-FBI chief James Comey with threatening to harm President Donald Trump after an Instagram post interpreted as a serious threat. The indictment marks a striking escalation in the ongoing political battles surrounding Trump-era figures.

The indictment, announced by U.S. Attorney W. Ellis Boyle and Acting Attorney General Todd Blanche, alleges that on May 15, 2025, Comey knowingly and willfully made a threat against the President by posting an image on Instagram containing the phrase "86 47." Prosecutors argue that anyone familiar with the context would interpret this as a serious expression of intent to inflict harm on the President.
Comey faces two counts: one under 18 U.S.C. § 871 for threatening the President’s life, and another under 18 U.S.C. § 875(c) for transmitting a threat across state lines via interstate commerce. If convicted, he could face up to 10 years in prison.
Acting Attorney General Blanche emphasized the seriousness of threatening a sitting President, highlighting recent violent incidents targeting Trump and other officials. “The temperature needs to be turned down,” Blanche said, warning that anyone who escalates threats against elected leaders will be held accountable.
FBI Director Kash Patel, known for his loyalty purges and politicization of the bureau during the Trump administration, praised the investigation and prosecution. Patel framed Comey’s alleged actions as a disgraceful betrayal of his former role leading the FBI, saying Comey “knew full well the attention and consequences” of his Instagram post.
The case is being prosecuted by Assistant U.S. Attorney Matthew R. Petracca, with the FBI conducting the investigation. U.S. Attorney Boyle stressed that the indictment is merely an accusation and that Comey is presumed innocent until proven guilty.
