Senate Republicans are pushing a massive $69 billion immigration enforcement package that locks in funding for ICE and CBP through 2029, including a staggering $38 billion for ICE alone. Buried in the bill is a punitive fee system designed to price migrants out of legal pathways, turning justice into a pay-to-play scheme.
Senate Judiciary Committee Chairman Chuck Grassley has unveiled the legislative text of the GOP reconciliation bill that commits nearly $39.2 billion to immigration enforcement through 2029. When combined with a separate $32.5 billion package from the Homeland Security and Governmental Affairs Committee, the total immigration enforcement funding balloons to roughly $69.2 billion — with ICE slated to receive about $38.2 billion.
This is not just more money; it’s a full-throttle expansion of the migrant mass removal machine. The Judiciary title funds ICE hiring, training, transportation, IT upgrades, and the controversial 287(g) program that deputizes local police to enforce federal immigration laws. The bill also allocates $750 million for Federal Law Enforcement Training Centers, $3.32 billion for the Department of Justice, and $5 billion for the Bureau of Prisons — including $3 billion earmarked for hiring and training new prison staff. And none of this comes with offsetting cuts, meaning taxpayers are on the hook for the full tab.
But the real kicker lies in the bill’s hidden fee structure. Immigrant advocates warn this creates a pay-to-play immigration system designed to block access to justice. Migrants apprehended between ports of entry would face a $5,000 fee just for being caught. Filing for adjustment of status would cost $1,500. Even applying for the diversity visa lottery would carry a $250 fee. Asylum seekers are hit with a $100 application fee plus another $100 for every year their case drags on, layering additional financial burdens on top of an already underfunded immigration court system.
Republicans are exploiting the budget reconciliation process — which requires only a simple majority and bypasses the filibuster — to ram this package through without a single Democratic vote. Senate Majority Leader John Thune has indicated the Senate could take up the bill within weeks.
Not all Republicans are on board. Senator Rand Paul voted against the budget resolution but remains involved in the process. Meanwhile, Democrats like Senate Budget ranking member Jeff Merkley condemn the package as a reckless funneling of billions into “Trump’s ballroom” and lawless agencies that trample on immigrant rights.
