Montgomery County Councilmember Evan Glass and the full County Council have introduced the “ICE Out Act,” legislation that would prohibit privately owned immigrant detention facilities from operating in Montgomery County.
Supporters of the bill say it is intended as a proactive measure to prevent U.S. Immigration and Customs Enforcement from establishing a private detention center in the County, citing concerns about due process, transparency, and accountability.
The proposed Bill 13-26 would amend County code to define “immigrant detention facility” and prevent the Department of Permitting Services from issuing building or use and occupancy permits for privately owned facilities. The legislation follows reports that ICE recently purchased a warehouse in Hagerstown, about 52 miles from Rockville, with plans to convert it into a detention center. The measure is co-led by the full Council and has been formally introduced for consideration.
