A federal magistrate judge sharply criticized the Washington, DC jail for its treatment of Cole Tomas Allen, the man accused of opening fire at the White House Correspondents’ Dinner on April 26. Allen allegedly rushed through security armed with a shotgun, aiming to assassinate former President Trump, who was attending the event along with top administration officials.

During a Monday hearing on Allen’s jail conditions, Judge Zia M. Faruqui condemned the Department of Corrections (DOC) for placing Allen on suicide watch and confining him under a five-point shackling system—conditions the judge said were more severe than those experienced by defendants involved in the January 6 Capitol attack.

“I’ve handled scores of cases involving defendants who took to the Capitol on January 6, 2021, and Allen’s allegations of treatment were worse than how those defendants were treated,” Faruqui said. The judge also took a pointed jab at Trump’s mass pardons of January 6 rioters, stating, “Pardons may erase convictions, but they do not erase history.”

Allen’s attorneys argued that the jail’s harsh treatment was unfair and unjustified. A jail representative acknowledged Allen was briefly placed on suicide watch following a medical evaluation but insisted final housing decisions had not yet been made.

In a rare moment of direct apology, Judge Faruqui told Allen, “I’m sorry. Whatever you’ve been through, I apologize for that now.” The judge also ordered the jail to provide Allen with a Bible he requested, noting that a “kind” jail guard had already shared some scripture with him.

This incident exposes a troubling pattern of inconsistent treatment within the justice system, where political violence linked to Trump’s supporters often receives leniency, while others face punitive measures that raise serious questions about fairness and accountability.
