Oklahoma Gov. Stitt Bypasses Legislature to Enforce Immigration Checks on Food Aid

Oklahoma Governor Kevin Stitt has taken a hardline step to restrict access to essential social programs by issuing an executive order mandating state agencies to verify immigration status for applicants of Medicaid, Temporary Assistance for Needy Families (TANF), and the Supplemental Nutrition Assistance Program (SNAP). This order, signed on May 6, directly implements proposals championed by the Trump administration that failed to pass in the Oklahoma Senate due to concerns about their impact on vulnerable children.

Stitt’s directive requires the Oklahoma Department of Human Services (DHS) and the Oklahoma Health Care Authority (OHCA) to use the federal Systematic Alien Verification of Entitlements (SAVE) system to confirm whether applicants are U.S. citizens. While undocumented immigrants are already barred from these programs, children born in the U.S. to undocumented parents remain eligible. This fact sparked fierce debate in the legislature, with Senate Pro Tem Lonnie Paxton blocking bills that would have mandated these checks, fearing the policies would scare undocumented parents away from applying for benefits that their citizen children desperately need.

Paxton warned that the bills could harm both mothers and babies by deterring access to healthcare and nutrition, stating, “Right now, whether that baby is being carried by an American citizen or not, to me it’s still a baby, and there’s a baby in a womb that needs to be protected.” Despite his concerns, Stitt bypassed the legislative deadlock, citing the need to protect “hard-earned tax dollars” from being spent on those “in this country illegally.”

The bills, HB 4422 and HB 4423, were initially pushed by House Speaker Kyle Hilbert, who framed the effort as aligned with directives from the Trump White House. Hilbert praised Stitt’s executive order, claiming Oklahoma taxpayers should not subsidize benefits for undocumented immigrants and emphasizing support for legal immigrants and immigration enforcement officers.

This move fits a broader pattern of authoritarian overreach and anti-immigrant policies characteristic of the Trump era, where executive power is wielded to circumvent democratic processes and impose harsh restrictions on immigrant communities. By using an executive order to enforce immigration verification for social services, Stitt is escalating the weaponization of welfare programs as tools of exclusion and intimidation.

The stakes are high: SNAP, TANF, and Medicaid provide critical lifelines for low-income families, many of whom already face economic hardship. Policies that chill access to these programs threaten not only immigrant families but the health and well-being of entire communities. Stitt’s order sends a clear message that political posturing on immigration will take precedence over protecting vulnerable children and families.

As Oklahoma moves forward with this policy, the human cost of these exclusionary tactics will become increasingly apparent.
