Last week, Republicans in Congress passed a budget framework allocating $70 billion to Immigration and Customs Enforcement (ICE) and Customs and Border Protection (CBP). The catch? They did it without any Democratic input, using a legislative maneuver called reconciliation to sidestep the usual Senate filibuster and bypass opposition entirely.

This is no ordinary budget fight. The Department of Homeland Security (DHS) funding had been stalled for over 10 weeks amid a bitter standoff. Democrats demanded reforms: end warrantless home raids, stop ICE and CBP agents from wearing masks, require body cameras, and other measures to curb abuses. Republicans flatly refused, triggering a partial shutdown.

Now, Republicans have gone rogue, pushing through this massive funding package alone. The Hill warns this sets a “dangerous precedent” that could open the door for one-party steamrolling of unpopular policies — including funding for a potential US-Israeli war with Iran, as Republican Congressman Mike Flood hinted.

Why the extra billions for ICE and CBP? These agencies already received nearly $140 billion in the last omnibus bill. When pressed, Republican Congressman Mike Lawler dodged specifics, responding only with a rhetorical question: “Are you for abolishing ICE?”

Under the Trump administration’s directive, federal agents have flooded Democratic-run cities like Los Angeles, Minneapolis, and Chicago, employing unconstitutional tactics that have led to deadly confrontations and at least three American deaths. DHS now holds a record 73,000 detainees nationwide, a grim legacy of brutal mass deportations and policies that deny asylum seekers freedom while awaiting hearings.

The use of reconciliation for routine agency funding is unprecedented. Traditionally, Congress followed “regular order,” a process established in 1974 requiring public hearings and debate on appropriations. But partisan gridlock has eroded this practice, pushing negotiations behind closed doors and into omnibus bills. Still, reconciliation has been reserved for budget bills with significant fiscal impact, not routine funding.

Democrats see this as a dangerous power grab. Congressman Rob Menendez warned the new funding could be used to intimidate voters in Democratic districts ahead of midterms. One of the Democrats’ key demands was to keep ICE and CBP out of the electoral fray — a demand Republicans rejected outright.

If Republicans can continue to funnel billions to ICE and CBP without bipartisan approval, it signals a chilling new chapter in MAGA’s consolidation of fiscal and political control. The question remains: can anyone stop this authoritarian funding playbook before it becomes the new normal?
