President Trump’s ongoing assault on vote-by-mail has met fierce resistance from a coalition of 20 Senate Democrats, spearheaded by Senator Alex Padilla (D-Calif.), Ranking Member of the Senate Rules Committee, along with Senators Dick Durbin, Gary Peters, and Majority Leader Chuck Schumer. In a sharply worded letter to Acting Attorney General Todd Blanche, the Senators condemned Trump’s March 31 executive order titled “Ensuring Citizenship Verification and Integrity in Federal Elections” as a blatant constitutional violation and a direct threat to voting rights.

The Senators’ letter makes clear that the President is once again attempting to exceed the limited constitutional authority granted to the Executive Branch over federal elections. Citing Article I, Section 4 of the Constitution, they emphasize that states hold primary responsibility for election administration, and Trump’s order unlawfully interferes with this authority. The predictable consequence, they warn, is disenfranchisement of tens of thousands of eligible voters, undermining the very foundation of American democracy.

Beyond the legal objections, the letter highlights the destructive impact Trump’s order would have on the Department of Justice’s Civil Rights Division, which has already been gutted under his administration. Since January 2025, the division lost 75 percent of its attorneys and shuttered dozens of major civil rights cases, shifting focus toward anti-trans and Second Amendment issues instead of protecting voting rights and fighting racial gerrymandering or police misconduct. The DOJ’s apparent disinterest in enforcing civil rights laws is further underscored by the dropping of approximately 23,000 criminal investigations in the first six months of Trump’s second term, with resources redirected toward harsh immigration enforcement.

The Senators demand that the DOJ not only halt any steps to implement this unlawful executive order but also provide all internal legal opinions, correspondence, and documents related to the order’s legality. This transparency request aims to expose the administration’s rationale and hold it accountable for attempts to weaponize the DOJ against voters.

Senator Padilla, a former California Secretary of State and a consistent critic of Trump’s anti-voter tactics, has been at the forefront of defending vote-by-mail. He introduced the Absentee and Mail Voter Protection Act to nullify Trump’s order and curb unlawful voter restrictions. Padilla has repeatedly spoken out against the SAVE Act and joined efforts to oppose changes to USPS policies that would hinder mail-in voting, such as the controversial postmark delays.

This coordinated pushback from Senate Democrats is a crucial stand against the Trump administration’s ongoing efforts to sow doubt in the electoral system and restrict access to the ballot box.
