SUN: Owner of proposed Elkridge ICE facility sues Howard County government

Genesis GSA Strategic One, owner of an Elkridge building that was slated to become a U.S. Immigration and Customs Enforcement detention center before Howard County officials pulled its permit, then banned all private immigration detention centers in Howard, filed a federal lawsuit Wednesday against the county.

The lawsuit, filed in the U.S. District Court for the District of Maryland in Baltimore, alleges that the county government violated the supremacy and contract clauses of the U.S. Constitution, which the plaintiff said would authorize the departments of Homeland Security and Justice to “carry out important assignments from Congress.”

Howard County revoked the permit for the project and passed emergency legislation to prohibit privately owned prisons in February, after county officials said they learned the facility would be used for immigration enforcement.

The lawsuit demands the county government not enforce the emergency bill and asks the county to reinstate or reissue the permit and award Genesis “compensatory damages.”
