On Thursday, the US Court of International Trade invalidated President Trump’s use of a 1974 trade provision, known as Section 122, to impose a 10 percent tariff on imports from virtually every country worldwide. The court found that the administration failed to prove the “large and serious” trade deficit required under the statute.
Just one day after the ruling, the administration filed an appeal, signaling its determination to cling to tariffs despite mounting legal and economic pushback. Yilun Zhang, trade manager at the Institute for China-America Studies, summed up the situation bluntly: “That said, psychologically and politically, the ruling is still a setback for the Trump administration. It forces the White House to scramble for alternative tariff authorities and reinforces the perception that the administration’s tariff toolkit is becoming more legally constrained.”
