The Department of Housing and Urban Development (HUD) has unveiled a new rule proposal that would dismantle existing protections for transgender people seeking federally funded housing and shelter. The change, announced by HUD Secretary Scott Turner, a known Christian nationalist, would replace the terms “gender” and “gender identity” with “sex” in HUD’s Equal Access regulations. This shift aligns with President Trump’s anti-transgender executive order from his second term, which falsely equates gender identity with biological sex—a claim widely rejected by scientists and courts.

Under the proposed rule, housing providers receiving federal funds could legally discriminate against transgender individuals by denying them access based on their gender identity. This represents a stark rollback of Obama-era policies designed to protect LGBTQ people from discrimination in housing—a sector where transgender individuals already face disproportionate challenges. Research from 2022 shows nearly one-third of transgender people have experienced homelessness at some point in their lives.

Turner framed the proposal as a defense of “biological reality,” declaring, “God created two sexes: male and female,” and condemning what he called “radical gender ideology.” Last year, Turner had already directed HUD to stop enforcing existing gender identity protections; this new rule codifies that directive into official policy.

Advocates warn the consequences will be devastating. Deborah Thrope, chief program officer at the National Housing Law Project, called the proposal a “baseless assault” and “cruel,” predicting it will force more transgender people onto the streets. She also highlighted the broader societal costs, including increased burdens on hospitals, social services, and local governments.

This proposal is part of a broader pattern of Trump administration efforts to weaponize federal agencies against marginalized communities, particularly LGBTQ people. By stripping away vital protections, the administration not only sanctions discrimination but also undermines democratic norms and civil rights.
