The case centers on a seemingly innocuous Instagram photo Comey posted in May last year showing seashells arranged on a North Carolina beach in the pattern “86 47.” While Comey said he assumed the numbers were a political message—not a call for violence—and quickly deleted the post, the Justice Department insists the arrangement constituted a threat to “take the life of” the 47th president.
Acting Attorney General Todd Blanche, a Trump loyalist and former personal lawyer to the ex-president, led the announcement alongside FBI Director Kash Patel and U.S. Attorney Ellis Boyle. Blanche refused to detail evidence of Comey’s intent but vowed to prove it “with witnesses, documents, and the defendant himself,” signaling a politically motivated prosecution rather than a straightforward legal case.
Comey, who was fired by Trump during the early months of the FBI’s Russia investigation and has been a vocal critic ever since, faces two counts: knowingly making a threat against the president and transmitting that threat across state lines. The indictment notably does not provide concrete proof that Comey intended harm, instead arguing a “reasonable recipient” would see the post as threatening.
The numbers “86” and “47” carry layered meanings. Merriam-Webster defines “86” as slang for “to get rid of” or “to kill,” a recent usage that Trump himself referenced in a Fox News interview, claiming Comey “knew exactly what that meant” and equating it to an assassination threat. Comey’s legal team vehemently denies any threat, pledging to fight the charges and defend First Amendment rights.
This indictment arrives months after a separate case against Comey was dismissed when a judge ruled the prosecutor was illegally appointed. That earlier case accused Comey of lying to Congress about authorizing information leaks to journalists during the Russia probe. The new charges, filed in the Eastern District of North Carolina where the seashells were found, deepen concerns about the Justice Department’s weaponization under Trump to target political foes.
Comey responded to the indictment with defiance: “I’m still innocent, I’m still not afraid and I still believe in the independent federal judiciary.” But the case underscores the alarming politicization of federal law enforcement under Trump loyalists like Blanche and Patel, who have turned the Justice Department into a tool for punishing critics and undermining democratic norms.
