Donald Trump’s latest executive order targeting mail-in ballots is not just another baseless attack on voting—it is an outright assault on the Constitution. Signed on March 31, this order directs the Department of Homeland Security to compile a national voter registry and mandates the Postal Service to send mail ballots only to those on this federal list. It further instructs the Department of Justice to investigate and prosecute state election officials who refuse to comply.
This is a direct violation of Article I, Section 4 of the U.S. Constitution, which clearly assigns sole authority over elections to the states. In response, Democratic groups, blue state officials, and voting rights advocates have swiftly filed lawsuits in Massachusetts and Washington, DC to block this illegal power grab.
Trump’s long-standing lies about mail-in voter fraud are the smokescreen for this move. He aims to invert the democratic process so that he controls who votes, rather than voters choosing their representatives. This is not speculation—it is the plain intent behind weaponizing federal agencies against state election systems.
The hypocrisy is glaring. Imagine if a Democratic president tried to impose a national voter list and mandate mail ballots for everyone on it, regardless of eligibility. David Becker, a former DOJ lawyer and election expert, points out that Republicans would be outraged and sue immediately. Yet, many red state Republicans silently cede their sovereignty to Trump, while election officials—Republicans and Democrats alike—express serious concern about the chaos and constitutional violations this order creates.
The Brennan Center for Justice highlights that Trump’s order threatens not only election officials but also postal workers, vendors, and volunteers who assist voters. Pennsylvania’s Republican Secretary of State Al Schmidt calls the order confusing and a recipe for sowing distrust in elections. Schmidt, who faced death threats for defending the 2020 election’s integrity, expects the courts to strike down the order.
The Trump administration’s assault on mail ballots is not about securing elections—it is about controlling who gets to vote.
